Your Responsibility for Vehicle Damage
By participating in a Lancaster Adventure Tours tour, you accept full financial responsibility for any damage to the vehicle(s) assigned to your group during your tour, including damage caused by any member of your party.
Damage You Are Responsible For
You are responsible for all damage to the assigned vehicle, including collision, rollover, undercarriage, tire and wheel damage, and damage resulting from off-road, reckless, or unsafe operation.
You are responsible for the reasonable cost of repairs, including parts, labor, towing, and other expenses directly related to the damage. Repair costs will be charged to the credit card on file, unless other arrangements have been made in advance.
Loss-of-Use Charges
You are also responsible for loss of use: the revenue Lancaster Adventure Tours loses while a damaged vehicle is out of service. Loss of use is calculated using the vehicle's average daily tour revenue and the reasonable period during which the vehicle is unavailable for inspection or repair.
Payment & Damage Billing
All reservations are paid in full at the time of booking. Lancaster Adventure Tours does not require a security deposit and does not place a pre-authorization hold on your card.
In the event of vehicle damage, repair costs and any applicable loss-of-use charges will be charged to the credit card on file, unless other arrangements have been made in advance.
Optional Limited Loss Damage Waiver (LLDW)
Lancaster Adventure Tours offers an optional Limited Loss Damage Waiver (LLDW) that reduces your financial exposure in the event of accidental vehicle damage.
Damage Covered by the LLDW
Subject to the exclusions below, the LLDW waives the first $2,000 of covered accidental physical damage repair costs, plus all associated loss-of-use charges. If covered repair costs exceed $2,000, you remain responsible for the amount above $2,000. Loss-of-use charges are covered in full by the LLDW and are not subject to the $2,000 repair cost limit.
Example: If covered repair costs total $3,000 and loss-of-use charges total $400, the LLDW waives the first $2,000 of repair costs and all $400 in loss-of-use charges. You are responsible for the remaining $1,000 in repair costs only.
Damage Not Covered by the LLDW
- Rollover damage
- Tire, wheel, or undercarriage damage
- Damage resulting from reckless, intentional, or unsafe operation
- Damage occurring outside the designated tour route
- Operation by an unauthorized driver
- Operation under the influence of alcohol or drugs
- Theft or vandalism
- Loss of personal belongings
- Personal injury to you, your passengers, or any third party
- Damage to another person's property or vehicle
- Repair costs exceeding $2,000 - you are responsible for the full amount above the waiver limit
The LLDW is not insurance. It is a contractual waiver of Lancaster Adventure Tours' right to seek recovery from you for the first $2,000 of covered accidental physical damage repair costs and all associated loss-of-use charges, subject to the exclusions above.
No Medical Insurance Provided
Lancaster Adventure Tours does not provide medical insurance, personal accident insurance, or personal liability insurance for tour participants. You participate in all tours at your own risk.
We strongly recommend that all participants carry their own health insurance and, if applicable, travel insurance that covers recreational activities. Lancaster Adventure Tours is not responsible for medical expenses, lost wages, or other costs arising from injury during a tour.
Assumption of Risk
Outdoor touring activities involve inherent risks, including uneven road surfaces, wildlife, weather conditions, and other vehicles. By booking and participating in a tour, you acknowledge and accept these risks.
You agree that Lancaster Adventure Tours, its owners, employees, and agents are not liable for injury, death, property damage, or loss arising from participation in a tour, except to the extent caused by Lancaster Adventure Tours' gross negligence or willful misconduct.
